The Ministry of Trade's Regulation on the Supervision of Products Sold via Remote Communication Tools Comes into Effect
The regulation regarding the supervision of products sold through remote communication tools has come into effect, as announced by the Ministry of Commerce. This regulation was published in today's Official Gazette.
In the statement from the Ministry of Commerce, it was noted: "The use of 'remote communication tools' for sales, primarily through internet channels, continues to increase in everyday life. Ensuring the delivery of safe products to our citizens underscores the growing importance of product safety inspections in this area. In this context, the 'Regulation on Market Surveillance and Inspection of Products Marketed Through Remote Communication Tools,' prepared by the General Directorate of Product Safety and Inspection, has been published in today's Official Gazette."
The significant changes introduced by the regulation are as follows:
- Inclusion of Product Information in Sales Advertisements Becomes Mandatory
- It is now mandatory to include necessary Turkish warnings and safety information, as well as markings, in product sales advertisements. This allows our citizens to examine the product while shopping online, just as they would in a physical store, and to verify that it carries the necessary markings.
- Sales Advertisements for Non-Compliant Products Will Be Removed Within 24 Hours If non-compliant products are detected on any website, the sales advertisement must be removed within 24 hours. If the request is not fulfilled within this period, access to the relevant advertisement will be blocked. Platforms Will Designate a 'Product Safety Contact Point'
- Platforms that facilitate the economic and commercial activities of others will designate a 'Product Safety Contact Point.' Our citizens will be able to report complaints and notifications regarding the safety and compliance of products through these contact points. Requirement for a Locally Established Economic Operator in Turkey
- To enable rapid action in the event of non-compliance, there is a requirement that certain products offered on the market must have a locally established economic operator in Turkey. Those who do not meet this condition will not be able to sell in Turkey. These product groups are published on the Ministry of Commerce's website.
